Institute Disciplinary Proceedings against Attorney General: Assin North MP

Member of Parliament for Assin North Constituency, Hon. James Gyakye Quayson has petitioned the General Legal Council to initiate disciplinary proceedings against the Attorney General and Minister of Justice, Godfrey Yeboah Dame for what he described as professional misconduct. 


The MP is facing criminal charges in relation to his 2020 election candidacy and subsequent winning. Even though the case is still in court, the AG has in series of interviews concluded that the MP will be jailed, and has consequently requested that the case be heard on a daily basis. 

According the petition filed on July 25, 2023 and addressed to the Chairman of the Disciplinary Committee of the General Legal Council, the MP contended that during the cross-examination of the first prosecution witness, Richard Takyi-Mensah, after the witness had testified confirming that he had given a statement to the police to which he attached certain documents, which testimony is also reflected in the police statement itself,  the Attorney-General, responding to an application by his counsel for disclosure of the attachments the witness referred to, stated that there were no attachments to the said police statement. 


This, he argued, clearly amounted to providing testimony to the court which he believe to be true, is clearly contrary to the rules of professional conduct by lawyers in a case, because the AGs arguement clearly contradicts that of his witness. 

Hon. Gyakye Quayson also cited another instance of this alleged misconduct on the part of the AG. "On 16th June 2023, when my lawyer was seeking to bring to the attention of the court that I was a candidate in the then pending Parliamentary bye-election in the Assin North Constituency, the AttorneyGeneral used the following insulting language against me: "This is what I describe as a very totally irresponsible step. Beside it, to apply to contest again when he knew that these proceedings were pending for which he can go to jail."  He continued that "this gratuitous insult on the part of the Attorney-General was without any basis and had no place in the trial and, I am advised by my lawyers, is contrary to the Rules of Professional Conduct of lawyers."

Hon. Quayson believe that this conduct from the AG violates his fundamental human rights which states that all persons charged with offences shall be deemed innocent until proven guilty.

The MP has therefore implored to the Disciplinary Committee of the General Legal Council to initiate disciplinary action against the AG.
